1. Application
1.1 Please read these General Terms and Conditions of Booking carefully. Your booking is made with Phuket Monster Fishing Park Co., Ltd., a company registered in Thailand (hereinafter referred to as ‘the Company’). These terms and conditions apply to any booking relating to the provision of services (in this case, the hire of fishing space and equipment, as well as catering) made by the Company or on its behalf, or by any of its subsidiaries, associated companies or agencies, regardless of the location o
1.2 We may amend these General Terms and Conditions of Booking from time to time by updating this page. The amended terms and conditions will take effect as soon as they are published.
1.3 Where a booking is made for several people, it is agreed that the main booker has the authority to accept, and does in fact accept, these General Booking Terms and Conditions on their own behalf and on behalf of the other people. In these General Booking Terms and Conditions, the terms ‘you’ and ‘your’ therefore refer to both yourself and the people for whom you have made the booking.
Payment
2.1 In order for us to confirm your booking, you must pay a deposit of at least 30% per person (the deposit or deposits).

If you cancel your booking
3.1 If, after the booking confirmation has been issued, you wish to change your stay (arrival and departure dates,
for example), we will do our best to make these changes free of charge, but this may not always be possible. Any request for a change must come from the person who made the booking. An administration fee per person, as well as any additional costs incurred as a result of the change, may be charged to you. Please note that these charges may increase as the arrival date approaches; we therefore advise you to contact us as soon as possible
Cancelling your booking
4.1 Any cancellation will result in a full refund of the service fee. Cancellation is permitted up to ten (10) calendar days before the scheduled booking date.
4.2 Any cancellation made by the customer less than ten (10) calendar days before the scheduled date of the service will not give rise to any refund, regardless of the reason.
5. Disclaimer regarding theft or loss
5.1 The Customer is solely responsible for keeping an eye on their personal belongings at all times whilst on the premises. The Operator accepts no liability for any loss, theft or damage to the Customer’s property occurring on or around the lake site.
6. If we change or cancel your booking
6.1 It is unlikely that we will need to make any changes to your booking once it has been confirmed, but we plan our services several months in advance. We may need to make changes, and we reserve the right to do so at any time. Most of these changes will be minor, and we will inform you as soon as possible
6.2 However, given the resort’s geographical location, it may be exposed to extreme weather conditions such as tropical depressions, flash floods, etc. There is also a risk of political and/or social instability that could affect your safety whilst there. Due to their unpredictability, these events, as well as other similar ones, constitute force majeure, and we shall not be liable for any changes made to your booking, before or after your departure, which we deem necessary to ensure your safety. In such cases, we will offer suitable alternative arrangements or, if the booking must be cancelled under these circumstances, we may credit the amounts paid towards a future booking. No compensation will be paid.
7. If you have a complaint
7.1 We will do our utmost to provide you with the Services, but in the unlikely event that you encounter a problem, you must immediately inform a representative of the Company during your stay. This will enable us to identify your problem quickly and resolve it more promptly. If you do not comply with this simple request, we will be unable to investigate your complaint and resolve it during your stay, which may affect your rights under this contract.
8. Limitation of liability
8.1 You shall be solely responsible for your own safety and the safety of any children travelling with you, including the safety of luggage and personal belongings, at all times.
8.2 The Company, its subsidiaries and affiliates accept no liability (of any kind) for any loss or damage of any nature whatsoever to your luggage, personal effects or other property belonging to you, or for any injury, illness, death or consequential loss suffered by you, whatever the cause. You assume all risks (of any kind) associated with the provision of the Services.
8.4 It is understood that the activities offered within ‘the complex’ involve an inherent risk. You accept the Services at your own risk and undertake to sign a liability waiver upon your arrival ‘at the complex’. This waiver must be read in conjunction with these General Terms and Conditions of Booking.
9. Customer Obligations – Conduct and Environment
9.1 “The Customer undertakes to behave in a manner that respects the environment, the facilities and other users of the site at all times. In particular, they shall ensure that the premises are kept clean, that no litter is left behind, that the flora and fauna are preserved, and that specific rules relating to recreational fishing are observed (in particular, respect for fish and catch-and-release guidelines where applicable). Any breach of these obligations may result in exclusion from the site without refund.”
9.2 You undertake to comply with all Thai laws relating to the possession and use of illicit substances, firearms and any contraband goods. The company management will report any such items to the authorities.
10. Applicable law and jurisdiction
10.1 These general booking terms and conditions and your legal relationship with the Company, its subsidiaries and affiliates shall be governed by and construed in accordance with the laws of Thailand.
10.2 In the event of any dispute, controversy or claim (of whatever nature) (“Dispute”) between you and the Company, its affiliates or associates, concerning the rights and obligations under these General Terms and Conditions of Booking, or concerning any other matter arising out of or in any way relating to these General Terms and Conditions of Booking, or concerning the provision of the Services, including (but not limited to) any matter relating to the existence, validity or termination of these General Terms and Conditions of Booking, such dispute shall be subject to the exclusive jurisdiction of the courts of Thailand.
11. Changes / Amendments
11.1 Any changes or amendments to these general booking terms and conditions are at the sole discretion of the operating company (Phuket Monster Fishing Park Co Ltd) at any time, unless otherwise expressly agreed in writing between the parties prior to any booking being made.
